How Delta-8 is Made

Now, this may be a bit confusing, since technically, hemp is a cannabis plant, and the name Cannabis sativa is the same latin name for the plant that produces high-THC marijuana.

In the 2018 farm bill, industrial hemp is officially classified as cannabis that contains less than 0.3% THC. Specifically, it was defined as "All derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent." But when we discuss "cannabis" or "marijuana", we’re commonly referring to cannabis plants with THC content of 0.3% or higher.

This language does not contain any delta-9 THC, making delta-8 legal through a gray area.

However, there are some states that have chosen not to adopt this specific language of the farm bill in their own state laws, thus banning delta-8 in certain states. Both manufacturers and vendors of delta-8 tend to sell only to states with laws that follow the same language as the 2018 Farm Bill. Still, there are some manufacturers that may only sell to certain states based on their own interpretation of a state’s laws.
